On Tuesday the Government Legislation Centre published a draft law amending the rules for managing state property, prepared by the Ministry of State Assets, tvn24.pl reports.
The draft tightens requirements for candidates to supervisory boards of companies with State Treasury participation: the required professional experience rises from 5 to 7 years, and MBA degrees will count only if obtained at universities entitled to award the habilitation degree or holding accreditation set by a Council of Ministers regulation. A new qualifying ground appears: at least five years on the management board of a large enterprise. Bodies nominating candidates will have to obtain self-assessment statements on their knowledge, skills and experience.
Corporate governance rules will be extended to subsidiaries of state companies. MPs, senators, MEPs and holders of local government offices will not be able to sit on the Council for companies with State Treasury participation and state legal persons; the minimum experience for its members rises to 10 years.
The draft provides for a new IT system for ownership oversight: the current database has operated since 1999 and relies on unsupported technologies. According to the regulatory impact assessment, the system will cost the budget PLN 11.2 million in 2027–2036.
